Conservation Commission Members Present: Pallotta McDermott, Fairbairn, Taverna, Bering, Martin

1.                  Public Hearing ? 71 Arlington Street, Construction of a parking lot adjacent to Sawins Pond.  Owner applicant: Maximos Hatziiliades.

 

Pallotta McDermott informed that the applicant requested a continuance to the February 3, 2010 meeting. 

 

Vote:  Taverna moved to continue the Public Hearing to the February 3, 2010.  Fairbairn seconded the motion.  The motion was unanimously approved.

 

2.                  Minutes of December 2009-Approved.

 

3.                  Old Business

 

Pallotta McDermott read the Agent?s Report dated 1/7/2010.

 

Vote:  Taverna moved to accept the Agent?s Report.  Fairbairn seconded the motion.  The motion was unanimously approved.

Whitney Hill Report

Hayward to research the Town Meeting records from the 1970s establishing annual appropriation to the CC.

Recycling Center/Filippello Park

Pallotta McDermott reported that the recycling center has been approved to be relocated to a Mt. Auburn Cemetery-owned site with a 10 year lease.

Storm Water Advisory Commission

Vote:  Taverna moved to accept Rose?s SWAC report.  Fairbairn seconded. CC unanimously accepted report.

Rules and Regulations

R&R adopted.

Rivers Protection Act

Hayward working with Assessor to update the RPA areas on the Town?s GIS map.

GSA

Collins reported that Anne Marie DesMarais is in agreement to act as the CC consultant for the review & response on the GSA Summary Report.  DesMarais requested that the CC ask for a 30 comment period if it was less. DesMarais noted that the Summary Report is not yet posted. (See below)   

EOEA Grant

No update.

Sawins Pond

Rose to provide updated information. (See below)

UPS

Hayward visited site twice.  He observed bottles, trash and snow dumping.  Hayward contacted UPS.  UPS agreed to clean up. Hayward to visit site after each snowfall.

Stanley Ave.

Scott sent a letter (12.4.09) to the owner regarding site violations and requesting a response within 30 days.  Bering noted that the letter did not id the violation affect on Walkers Pond.  Pallotta McDermott will discuss the matter with Hayward.

 

4.                  GSA Site

 

Vote:  Bering moved that Pallotta McDermott write a letter requesting under the Public Records Act the Summary Report for the GSA site.  Taverna seconded the motion.  The motion was unanimously approved.

 

Bering requested that the data available for DEP on the GSA site be obtained for DesMarais.  He questioned the imposition of a comment period of 20 to 30 days.  Bering suggested that Ellen Iorio be contacted ASAP regarding the report and an electronic version be obtained for the CC.

 

Pallotta McDermott to contact Hayward to discuss the matter.

 

5.                  Sawins Pond

 

Vote:  Bering moved to request that Pallotta McDermott write a letter to DEP requesting records on Sawins Pond and that DEP move as soon as possible on the clean-up at Sawins Pond.  Taverna seconded the motion.  The motion was unanimously approved.

 

Bering was not sure who to address the letter.  Debra Hawks was identified.  Bering suggested calling Hawks to find out what was going on.

 

Paul Hatziiliades, son of the owner of 71 Arlington Street, responded that his contact at DEP was Steve Johnson, Director of the NE District of DEP.  He noted that it was difficult to obtain information from DEP who continues to move the deadline on their determinations.

 

Pallotta McDermott to contact Hayward to discuss the matter.
